 Het Hof van Arbitrage voor Sport (CAS) maakte woendag zijn beslissing bekend in het beroep dat door de Union Cycliste International (UCI) was ingediend tegen het besluit van de Anti-Doping Comite van de Deense Nationale Olympisch Comite (DIF)
betreffende het geval van de Deense wielrenner Alex Rasmussen.
De UCI had beroep aangetekend bij het CAS met het verzoek Alex
Rasmussen te schorsen voor een periode van twee jaar na twee gemiste
dopingcontroles en een procedurefout in zijn whereabouts binnen een periode van 18 maanden. De DIF Anti-Doping Commissie had Rasmussen eerder
vrijgesproken op basis van een procedurefout die gemaakt zou zijn door de UCI. Rasmussen is een schorsing opgelegd van 18 maanden ingaande op 1 oktober 2011 (verminderd met de duur van de
voorlopige schorsing die hij al heeft gediend). Bovendien zijn de
resultaten van Alex Rasmussen in de periode van 28 april 2011 t/m 14
september 2011 (begindatum van zijn voorlopige schorsing) ongeldig verklaard. Zijn ploeg Garmin-Sharp heeft hem na het horen van de uitspraak per direct ontslagen. Persmededeling CAS: Lausanne, 4 July 2012
- The Court of Arbitration for Sport (CAS) has rendered its decision in
the appeal filed by the Union Cycliste International (UCI) against the
decision of the Anti-Doping Committee of the Danish National Olympic
Committee (DIF) concerning the case of the Danish cyclist Alex
Rasmussen.
The UCI filed an appeal with the CAS to
request that Alex Rasmussen be suspended for a period of two years
following two missed anti-doping tests and one failure to file
whereabouts information within a period of 18 months. The DIF
Anti-Doping Committee had previously acquitted the rider on the basis of
a procedural mistake allegedly committed by the UCI. The CAS ruled that
the procedural mistake (delay in communications) did not change the
fact that an anti-doping test was missed by Alex Rasmussen after he had
committed two other failures for which he had received proper notice.
Accordingly, the CAS has partially upheld UCI's appeal and has imposed a
suspension of eighteen months on the rider, commencing on 1 October
2011 (less the period of the provisional suspension that he has already
served). Furthermore, the results achieved by Alex Rasmussen in the
period from 28 April 2011 to 14 September 2011 (start date of his
provisional suspension) will not be disqualified.
